Oklahoma's Consumer Protection Act (15 O.S. Section 751 et seq.) provides a private right of action under 15 O.S. Section 761.1. Consumers may recover actual damages, and for willful violations, up to three times actual damages. Attorney fees are also recoverable. The statute of limitations is two years from discovery under 12 O.S. Section 95(A)(9). The Oklahoma AG enforces the Act and may seek civil penalties up to $10,000 per violation, injunctions, and restitution. Oklahoma requires contractors to be licensed by the Oklahoma Construction Industries Board (OCIB) under 59 O.S. Section 1000.4. Plumbing, electrical, mechanical, and HVAC contractors must hold state licenses. Oklahoma also requires home warranty service companies to be licensed, providing additional consumer protections for home service contracts.
